DARN FOUNDATION Darn Foundation (“Darn Foundation”, “we”, “us”,”our”) is registered as a Not-for-Profit organisation under Section-8 of the Companies Act with a vision to works towards a gender equal society in which girls and women can exercise their rights. These following terms of use (“Terms”) govern your usage of Darn Foundation’s website (“Website”). We may revise these Terms from time to time, therefore it is strongly recommended for you to return to this page periodically and review the most current version of the Terms in force.

  • The Website is freely accessible and can be used by anyone in India or abroad. You can use and access our Website to see the campaigns and activities we are involved in, to make donations or to apply for a job with us.
  • All content, data, design, information or other materials available on and underlying the Website (collectively “Content”), including but not limited to software underlying the Website or which are required for accessing or using the Website, images, text, layouts, arrangements, displays, illustrations, photographs, graphics, audio and video clips, HTML files and other content, logos, trademarks including the trademark DARN FOUNDATION, Darn Foundation, Darn Foundation and other trademarks that may be used on the Website or elsewhere are the property of Darn Foundation and/or its licensors and are protected by copyright and/or other applicable intellectual property right laws. Darn Foundation, on behalf of itself, its affiliates and its licensors, disclaims all warranties of any kind, whether express or implied, relating to the Content or the Website. Darn Foundation shall not be responsible for any errors, omissions, inaccuracies in the Content or for any user’s reliance on the information.
  • These Terms are applicable to all donations made through the Website. When you make any donation, your transaction will be processed by the payment service provider we contract with. In order to process your donation, you must provide us with your details, including your name, address, email address, and the details of the payment instrument (debit card, credit card, net banking, etc.) that you wish to use for the donation. We do not have access to your payment data which is collected and processed only by our payment service providers. It is important that you review their terms and privacy policy, which are different from ours, to ensure that you are comfortable with how your payment data is processed.
  • We also provide links and buttons to third-party websites such as Twitter, YouTube, Facebook, etc. on our Website. However, information collected through these third-party links and buttons is collected directly by these third parties, not by Darn Foundation. Information collected by a third party in this manner is subject to that third party’s own data collection, use, and disclosure policies. Darn Foundation is not expressly or impliedly responsible for, or liable to any loss or damage caused to users by the collection, use and retention of personal information by such third party in any manner whatsoever. Darn Foundation takes no responsibility for the content of these third-party websites, and Darn Foundation shall not be liable for any direct or indirect damages resulting from the use of third-party websites.
  •  Darn Foundation shall not be liable to you or any third party for any special, indirect, incidental, consequential, or punitive damages arising out of or relating in any way to our Content or the use of our Website. You hereby indemnify Darn Foundation and its affiliates from all liabilities, claims, damages, costs, and expenses, including attorney’s fees and expenses and any amounts paid by Darn Foundation to a third party in settlement of a claim, incurred by Darn Foundation arising out of any breach by you of any provision of these Terms or arising out of any claim that you have breached these Terms.
  •  In case of a breach of these Terms in any way, Darn Foundation may take appropriate action in response to the breach, including but not limited to suspending your access to the Website and/or instituting court proceedings against you.
  • These Terms shall be construed, interpreted and applied in accordance with, and shall be governed by, the laws applicable in India. The courts in Bengaluru shall have the exclusive jurisdiction to entertain any dispute or suit arising out of or in relation to these Terms.
  •  We expect you to exercise due care and diligence while making any donations using the Website. However, we recognize that a donation may be made erroneously or donors may change their mind. Therefore, in order to ensure fair and transparent processing of requests for refund or cancellation of donations, we examine each request and Endeavour to make the refund or cancellation. Darn Foundation is not obliged to make refunds and may, in its discretion, decline any requests for refund of donations, particularly if a tax exemption certificate has been issued. All requests of refund or cancellation must be made to our email address at donations@Darn.foundation within seven (7) days from the date of donation, along with the reason for requesting refund or cancellation, the details of the amount donated and the mode of payment. We may need to seek additional information from you and you are expected to co-operate in this regard. All decisions of Darn Foundation in this regard will be final and binding on the donor.

CONDITIONS OF USE

User Conduct: You are solely responsible for all Campaign descriptions, comments, video, images, information, data, text, software, music, sound, photographs, graphics, messages or other materials (“content”) that you upload, post, publish or display (hereinafter, “upload”) or transmit or otherwise use via the Services. The following are examples of the kind of content and/or use that is illegal or prohibited by Darn Foundation. However, this list is not exhaustive and Darn Foundation reserves the right to investigate anyone by engaging public and private organizations, including, but not limited to collection agents, private investigators, and local, state, federal and international agencies, and take appropriate action against anyone who, in Darn Foundation’s sole discretion, violates any of the terms or spirit of these Terms of Service (or the principles described in our preamble hereto), including, without limitation, removing the offending content, suspending or terminating the account of such violators, stopping payments to any such Campaign, freezing donated funds when Darn Foundation reasonably believes it to be required by applicable law, and reporting you to the law enforcement authorities or otherwise taking appropriate legal action. Without limiting the foregoing, you agree to not use the Services to:

  • establish or contribute to any Campaign with the implicit or express purpose relating to any of the following:
    • any activity that violates any law or governmental regulation;
    • content or campaigns that are fraudulent, misleading, inaccurate or dishonest;
    • illegal drugs, narcotics, steroids, controlled substances or other products that present a risk to consumer safety or any related paraphernalia;
    • knives, explosives, ammunition, firearms, or other weaponry or accessories;
    • annuities, investments, equity or lottery contracts, lay-away systems, off-shore banking or similar transactions, money service businesses (including currency exchanges, check cashing or the like), debt collection or crypto-currencies;
    • gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, fantasy sports, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill or chance (whether or not it is legally defined as a lottery) or sweepstakes;
    • the promotion of hate, violence, harassment, discrimination or terrorism, or racial, ethnic, or gender intolerance of any kind;
    • libel, slander, defamation by implication (not proven in the court of law) against any person, whether living or dead, or any organization;
    • violation of any third party rights;
    • human trafficking or exploitation;
    • pornography or other sexual content;
    • offensive, graphic, perverse or sensitive content;
    • the defense or support of anyone alleged to be involved in criminal activity;
    • offering monetary rewards, including gift cards;
    • funding an abortion, unless in accordance with applicable laws;
    • ending the life of an animal;
    • transactions for the sale of items before the seller has control or possession of the item;
    • collection of payments on behalf of merchants by payment processors or otherwise; or
    • credit repair or debt settlement services;
    • activities with, in, or involving countries, regions, governments, persons, or entities that are subject to Indian and other economic sanctions under applicable law, unless such activities are expressly authorized by the appropriate governmental authority;
    • utilisation for political and/or electoral purposes including but not limited to contesting elections or any election related expenses, lobbying, organising protests, mass mobilisation of people, campaign for or against any political party, or any activity that could be interpreted as a political campaign by potential donors or authorities;
    • utilisation for activities that propagate/preach a religion including but not limited to construction and/or consecration of religious symbols, institutions, events, evangelism, organizing sermons, or any other activity that could be interpreted as a religious activity by potential donors or authorities.
  • transmit or otherwise upload any content that
  • infringes any intellectual property or other proprietary rights of any party;
  • you do not have a right to upload under any law or under contractual or fiduciary relationships
  • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • poses or creates a privacy or security risk to any person;
  • constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; or
  • in the sole judgment of Darn Foundation, is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose Darn Foundation or its users to any harm or liability of any type; or
  • interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; or
  • harvest or collect email addresses and/or identifiable information of other users from the Services by electronic or other means
